Welcome to TalentPass, a platform developed by Gobekli Inc. (“Gobekli,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of TalentPass, including the Talent Tree, Passport Pages, Pythia AI, websites, mobile apps, APIs, and related services (collectively, the “Platform”).
By accessing or using the Platform, you agree to these Terms and to our [Privacy Policy] and (if applicable) the TalentPass Participation Agreement (the “Participation Agreement”), each incorporated by reference. If you do not agree, do not access or use the Platform.
1) Eligibility & Accounts
1.1 Minimum Age. You must be at least 13 years old (or older where required by law). If you are under 18, you must have parental/guardian consent. By using the Platform, you represent and warrant you meet these requirements.
1.2 Registration & Accuracy. You must provide accurate, current, and complete information and keep it updated. You are responsible for all activity under your account.
1.3 Credential Security. Safeguard your login credentials. Notify us promptly of any unauthorized use or breach. We may suspend or disable accounts for suspected misuse.
1.4 Organizational Users. If you create or use an account on behalf of an organization, you represent you are authorized to bind that organization to these Terms.
2) The Platform & Availability
2.1 Service Evolution. We continuously improve the Platform. Features may change, be added, or removed.
2.2 Availability. We strive for reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, updates, or outages may occur.
2.3 Device & Access. You are responsible for compatible devices, software, and internet access.
3) Your Content & Data Ownership
3.1 Ownership. You retain ownership of content and data you submit to TalentPass, including Talent Tree entries, reflections, uploads, goals, and profiles (“User Content”).
3.2 License to Operate the Service. You grant Gobekli a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display User Content solely to operate, secure, support, improve, and provide the Platform and its features to you and (where you consent) to connected organizations.
3.3 No Sale of Your Personal Data. This license does not transfer ownership, and we do not sell your personal data.
3.4 Backups. You are responsible for maintaining backups of your User Content.
3.5 Feedback. If you submit ideas, suggestions, or feedback (“Feedback”), you grant Gobekli a perpetual, irrevocable, royalty-free license to use it without obligation to you.
4) Platform License & Restrictions
4.1 Your License. Subject to these Terms, Gobekli grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes.
4.2 Prohibited Uses. You agree not to:
- Modify, decompile, reverse engineer, or attempt to extract source code;
- Copy, rent, lease, sell, sublicense, or distribute any portion of the Platform;
- Use bots, scrapers, or similar data-gathering methods without written consent;
- Build or benchmark competing products or models using the Platform;
- Circumvent security, access controls, rate limits, or usage caps;
- Interfere with service operation or other users’ experience;
- Upload malware or harmful code;
- Violate laws, infringe IP or privacy rights, or harass, discriminate, or harm others.
4.3 Reservation of Rights. All rights not expressly granted are reserved by Gobekli and its licensors. The Talent Tree architecture, Pythia, STAMP, UI, and underlying models are protected by IP laws.
5) AI Features & Disclaimers
5.1 Nature of Pythia. The Platform includes AI features via Pythia that may generate text, summaries, or guidance based on your input and context. Outputs may be imperfect or incomplete.
5.2 No Professional Advice. AI outputs are for reflection and decision support only, not professional, medical, mental health, legal, immigration, compliance, or financial advice.
5.3 Human Oversight. Do not rely solely on AI outputs for consequential decisions (e.g., hiring, academic, health, legal). Use judgment and, where appropriate, consult qualified professionals.
5.4 Explainability. We strive for transparency and safe use. We may provide summaries or indicators, but we are not obligated to disclose full model details.
6) Passport Pages & Organizational Connections
6.1 Passport Pages. If an organization (e.g., employer, school, agency) uses Gobekli’s TalentSync, it may issue a Passport Page representing your role, goals, or participation in that organization.
6.2 Optional Connection. Connecting a Passport Page to your TalentPass is voluntary and consent-based. By connecting, you authorize data exchange between your account and the organization according to your selections.
6.3 Visibility Controls. You choose what to share. Private reflections, personal documents, and AI conversations remain private unless you explicitly share them.
6.4 Disconnecting. You may revoke a connection at any time. Previously shared data may remain in the organization’s records consistent with their policies and applicable law; future updates stop syncing.
7) Privacy & Data Processing
Your use is subject to our [Privacy Policy], which explains what we collect, how we use it, legal bases, retention, rights, and choices. TalentPass is designed for consent-first data sharing and portability.
8) Subscriptions, Fees & Taxes (If Applicable)
8.1 Plans. Some features may require a paid plan. Plan terms (prices, billing cycles, limits) will be shown at purchase.
8.2 Billing. Fees are billed in advance and are non-refundable unless required by law or our posted refund policy.
8.3 Changes. We may change fees or plan features prospectively. We will provide notice for material changes.
8.4 Taxes. You are responsible for applicable taxes unless we are required to collect them.
9) Third-Party Services & Links
9.1 Integrations. The Platform may interoperate with third-party tools (e.g., credential issuers, storage). Your use of those services may be subject to their terms and privacy policies.
9.2 No Endorsement. Links or interoperability do not imply endorsement or responsibility for third-party services.
10) Intellectual Property; DMCA
10.1 Our IP. Gobekli and its licensors own the Platform and all associated IP.
10.2 Your IP. You own your User Content, subject to the service license in §3.2.
10.3 DMCA. If you believe content infringes your copyright, send a notice to legal@gobekli.org with: (a) your contact info; (b) identification of the work and allegedly infringing material; (c) a statement of good-faith belief; (d) a statement under penalty of perjury; and (e) your signature. We may remove content and terminate repeat infringers.
11) Term; Suspension; Termination
11.1 Term. These Terms apply from your first use of the Platform until terminated.
11.2 By You. You may stop using the Platform and (where available) delete your account or request deletion via support@gobekli.org.
11.3 By Gobekli. We may suspend or terminate access for violations, security risks, non-payment, or as required by law.
11.4 Effect. Upon termination, your license ends and access ceases. We may retain and use aggregated or de-identified data as permitted by law and our Privacy Policy.
12) Disclaimers
THE PLATFORM (INCLUDING AI OUTPUTS) IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBEKLI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBEKLI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED $100 USD.
Some jurisdictions do not allow certain exclusions or limitations; in such cases, they apply to the fullest extent permitted.
14) Indemnification
You will indemnify and hold harmless Gobekli and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your User Content; (b) your use of the Platform in violation of law or these Terms; or (c) your infringement or misappropriation of third-party rights.
15) Export, Sanctions & Geographic Restrictions
You must comply with applicable export control and sanctions laws and may not use the Platform if you are located in, or are a person or entity ordinarily resident in, or organized under the laws of, a comprehensively sanctioned jurisdiction, or if you are on a restricted party list.
16) Governing Law; Dispute Resolution
16.1 Law. These Terms are governed by the laws of the State of California, without regard to conflict of law rules.
16.2 Binding Arbitration. Any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in San Francisco, California, unless both parties agree otherwise. The arbitrator’s award may be entered in any court of competent jurisdiction.
Exceptions. Either party may seek injunctive relief in court for IP infringement or misuse of confidential information.
16.3 Class Action Waiver. Disputes must be brought in an individual capacity and not as a class, collective, or representative action.
17) Changes to these Terms
17.1 Updates. We may update these Terms. The “Last Updated” date will reflect changes, and we may provide notice for material changes.
17.2 Your Continued Use. Continued use after changes constitutes acceptance. If you disagree, stop using the Platform.
18) Miscellaneous
18.1 Entire Agreement. These Terms, the [Privacy Policy], and any applicable Participation Agreement are the entire agreement between you and Gobekli regarding the Platform.
18.2 Severability. If any provision is unenforceable, the remainder remains in effect.
18.3 No Waiver. Failure to enforce a provision is not a waiver.
18.4 Assignment. You may not assign these Terms without our consent. Gobekli may assign them in connection with a merger, acquisition, or sale of assets.
18.5 Force Majeure. We are not liable for delays or failures due to causes beyond our reasonable control (e.g., natural disasters, labor disputes, internet failures).
