TalentPass Participation Agreement

Effective Date: [Nov 1, 2025]

This Participation Agreement (“Agreement”) is entered into between you (“Participant,” “you,” or “your”) and Gobekli Inc. (“Gobekli,” “we,” “us,” or “our”). It governs your access and use of TalentPass, the officially released version of Gobekli’s Universal Talent Passport—a personal and interoperable platform for exploring, structuring, and verifying human potential through Pythia, the Talent Tree, and Passport Pages.

By creating an account, connecting a Passport Page, or using any part of the TalentPass platform, you agree to the terms of this Agreement, along with Gobekli’s [Terms of Service] and [Privacy Policy], which are incorporated by reference. If you do not agree, do not use TalentPass.


1. Purpose and Scope

1.1 TalentPass Platform

TalentPass is a secure, user-owned digital record system that helps individuals map and verify their learning, skills, and growth. It combines:

  • The Talent Tree, Gobekli’s universal framework for mapping human capability;
  • Pythia, an AI reflection system that supports self-understanding, career planning, and credential creation;
  • Passport Pages, connections between individuals and organizations (schools, employers, agencies) that enable verified, consent-based data exchange.

1.2 Full Release Program

This Agreement applies to the publicly available version of TalentPass (“Full Release”), including any connected modules, applications, and third-party integrations.

1.3 Non-Transferable Use

Your TalentPass account is personal and may not be assigned, transferred, or sublicensed without Gobekli’s written consent.


2. Eligibility and Acceptance

2.1 Age and Consent

You must be at least 13 years old (or older where required by law). Users under 18 must have parental or guardian consent.

2.2 Acceptance

By signing up or using the platform, you agree to this Agreement in full.

2.3 Relationship

This Agreement does not create any employment, partnership, or agency relationship between you and Gobekli.


3. Nature of the Platform

3.1 Continuous Development

TalentPass is a continuously evolving platform. Features, functions, and integrations may be updated or replaced as the system matures.

3.2 System Components

TalentPass includes:

  • The Personal Reflection Layer (Pythia Type II conversations);
  • The Talent Tree Data Layer (structured talent mapping and verification);
  • The Organizational Layer (Passport Pages and TalentSync integration);
  • The Verification Layer (credential and evidence management).

3.3 Access and Service Continuity

While Gobekli strives for high availability, maintenance, or updates may cause temporary downtime or feature changes.


4. License and Use Restrictions

4.1 License Grant

Gobekli grants you a personal, limited, revocable, non-exclusive, non-transferable license to use TalentPass for personal development and verified data management.

4.2 Restrictions

You agree not to:

  • Modify, copy, reverse-engineer, or redistribute TalentPass code or assets;
  • Use the platform to build competing products or datasets;
  • Interfere with security, privacy, or data integrity;
  • Misrepresent or falsify data or credentials.

5. Confidentiality and Intellectual Property

5.1 Proprietary Elements

TalentPass, the Talent Tree framework, and the Pythia system are proprietary to Gobekli and protected by copyright and trade secret law.

5.2 Shared Knowledge Model

While reflections and data structures are user-owned, the algorithms, taxonomies, and interface logic remain Gobekli IP.

5.3 Confidentiality of System Materials

You may not disclose or reproduce unreleased functionality or proprietary materials without consent.


6. Feedback and Contribution

6.1 Voluntary Feedback

You may share ideas, suggestions, or reports with Gobekli (“Feedback”).

6.2 License to Use Feedback

You grant Gobekli a perpetual, royalty-free license to use, modify, and apply Feedback to improve the platform and related systems.


7. Data Ownership and Privacy

7.1 Your Data

You own all personal data and reflections you create within TalentPass. Gobekli acts as a data processor, providing tools for you to view, edit, export, or delete your data at any time.

7.2 Shared Data via Passport Pages

When you connect to an organization through a Passport Page:

  • You control what data is shared and for how long.
  • Shared data becomes part of that organization’s record under its own retention policies.
  • You may revoke access at any time; previously shared records remain archived as permitted by law.

7.3 AI Interaction Logs

Anonymized interaction data (e.g., prompts, topic metadata, usage patterns) may be analyzed to improve Pythia’s reasoning quality and safety—never shared with third parties or public AI models.

7.4 Privacy and Consent

TalentPass follows a Consent-First Architecture, meaning no data is written, connected, or shared without your explicit approval.


8. Interoperability and Verifiable Credentials

8.1 Open Standards

TalentPass supports interoperability with recognized standards including W3C Verifiable Credentials (VCs), Open Badges, and LER frameworks.

8.2 Data Portability

You can export your verified records and experiences for use across compatible systems, schools, or employers.

8.3 Organizational Pages

Passport Pages allow you to receive verified data, credentials, and learning resources from institutions while maintaining full control of your identity and access permissions.


9. Termination

9.1 By You

You may close your account at any time. You can export or delete your data via the account dashboard or contact support@gobekli.org.

9.2 By Gobekli

Gobekli may suspend or terminate your access for policy violations, security concerns, or system maintenance.

9.3 Post-Termination

Upon termination:

  • Your account access ceases immediately.
  • Gobekli may retain anonymized or aggregated data for analytics, compliance, or research purposes.
  • Sections 5–12 remain enforceable.

10. Warranty Disclaimer

TalentPass is provided “as is.” Gobekli disclaims all implied warranties, including merchantability, fitness for a particular purpose, or accuracy of AI interpretations. Pythia is a reflective and advisory system, not a substitute for professional, medical, or legal judgment.


11. Limitation of Liability

To the maximum extent allowed by law:

  • Gobekli shall not be liable for indirect or consequential damages, data loss, or lost opportunities;
  • Total liability shall not exceed $100 USD.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of California, USA, without conflict of law principles.
Disputes will be resolved via binding arbitration in San Francisco, CA, under the American Arbitration Association Consumer Rules.
No class actions or representative claims are permitted.


13. Miscellaneous

  • Entire Agreement: This document supersedes all prior agreements regarding TalentPass participation.
  • No Waiver: Failure to enforce any provision shall not constitute waiver.
  • Severability: If any part is invalid, the remainder remains in force.
  • Assignment: You may not assign rights; Gobekli may assign this Agreement in connection with a merger or reorganization.

14. Acceptance

By creating an account or continuing to use TalentPass, you affirm that you have read, understood, and agree to this Participation Agreement.
