TalentPass Terms of Service

Welcome to TalentPass, a platform developed by Gobekli Inc. (“Gobekli,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of TalentPass, including the Talent Tree, Passport Pages, Pythia AI, and any associated mobile applications, websites, APIs, or services (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms and our [Privacy Policy] and [Beta Participation Agreement], which are incorporated by reference. If you do not agree to all these terms, you may not access or use TalentPass.
1. Eligibility and Account Responsibilities
1.1 Minimum Age
You must be at least 13 years of age (or older if required by your country or state) to use TalentPass. If you are under 18, you must have the consent of a parent or legal guardian. By using the Platform, you represent and warrant that you meet these requirements.
1.2 Account Information
To use certain features, you must register an account and provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity under your account. You agree not to impersonate anyone else or misrepresent your affiliation with any person or organization.
1.3 Account Security
You agree to notify Gobekli immediately of any unauthorized use of your account or any other breach of security. We reserve the right to disable any account or credentials if we suspect unauthorized activity or breach of these Terms.
2. Beta Participation and Platform Availability
2.1 Beta Disclaimer
TalentPass is currently offered as a Beta release. As such, it is a pre-release version that may contain bugs, incomplete features, or unexpected behaviors. You acknowledge that:
- The Platform is provided “as is” and may be modified, updated, suspended, or discontinued at any time without notice.
- Features may be experimental or subject to significant change or removal.
- Downtime, data loss, or service interruptions may occur.
2.2 No Service Guarantee
We make no guarantees regarding the availability, performance, or reliability of the Beta version. We are not liable for any loss or damage arising from your reliance on any part of the Platform during this Beta period.
3. User Content and Data Ownership
3.1 Ownership of Your Content
You retain ownership of all original content and data you input into TalentPass, including entries in the Talent Tree, Pythia conversations, reflections, goals, uploads, and custom profiles (“User Content”).
3.2 License to Gobekli
By submitting or storing User Content on the Platform, you grant Gobekli a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, host, and display that content solely for the purpose of operating, improving, and providing the Platform to you and other users.
This license does not give us ownership of your content, nor does it grant us the right to sell or publicly disclose your personal data.
3.3 Feedback and Suggestions
If you choose to submit feedback, ideas, or suggestions about the Platform (“Feedback”), you agree that Gobekli may use such Feedback without obligation or compensation to you. You waive any claim to intellectual property rights in features or changes derived from your Feedback.
4. Acceptable Use and Conduct
You agree not to use the Platform in any way that:
- Violates any applicable law or regulation;
- Infringes on the rights of any third party, including intellectual property rights or rights of privacy;
- Harms, exploits, or attempts to harm minors in any way;
- Uploads, transmits, or distributes viruses, malware, or other harmful code;
- Attempts to gain unauthorized access to the Platform or related systems;
- Misuses or overloads Gobekli’s infrastructure, or circumvents intended usage flows (e.g., data scraping, reverse engineering);
- Generates or disseminates misleading, discriminatory, harassing, or harmful content using Pythia or other AI-based features;
- Attempts to impersonate any individual, entity, or misrepresent your affiliation.
Gobekli reserves the right to investigate and take appropriate action, including disabling or terminating accounts, in cases of suspected violations.
5. License and Platform Restrictions
5.1 License to Use TalentPass
Subject to your compliance with these Terms, Gobekli grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal or organizational purposes as intended.
You may not:
- Modify, decompile, reverse engineer, or disassemble any part of the Platform;
- Copy, rent, lease, sell, sublicense, or otherwise distribute any portion of the Platform;
- Use any data mining, bots, or similar data gathering methods;
- Access or use the Platform to build or benchmark competing products;
- Circumvent any security or access restrictions of the Platform;
- Interfere with the normal functioning of the Platform or the experience of other users.
5.2 Reservation of Rights
All rights not expressly granted to you under these Terms are reserved by Gobekli and its licensors. You acknowledge that the Platform and its underlying technologies—including the Talent Tree architecture, STAMP, and Pythia AI—are protected by intellectual property laws.
6. AI Use and Disclaimers
6.1 Nature of AI Services
The Platform incorporates AI-driven features through Pythia, a conversational AI system. Pythia generates suggestions, reflections, recommendations, and other outputs based on your input and system context.
You acknowledge and agree that:
- Pythia is not a human advisor and may generate imperfect, inaccurate, or speculative information.
- Outputs may reflect the phrasing, tone, or content of your inputs.
- AI-generated outputs should not be relied upon as legal, psychological, medical, financial, academic, or professional advice.
6.2 No Reliance for Critical Decisions
You agree not to rely solely on AI-generated content for:
- Educational or career decisions,
- Diagnosing or treating health or mental health issues,
- Legal, immigration, or compliance matters,
- Employment or hiring decisions made without human review.
6.3 Explainability and Transparency
Gobekli is committed to explainable AI and ethical data use. Where applicable, we may offer summaries, confidence indicators, or training source transparency. However, full transparency of model architecture or outputs is not guaranteed.
7. Passport Pages and Organizational Connections
7.1 What Are Passport Pages?
If you participate in an educational program, employer group, nonprofit, or public agency using TalentSync, you may be issued a Passport Page—a profile stub that represents your role, goals, and participation within an organization.
7.2 Voluntary Connection to TalentPass
Connecting your Passport Page to your TalentPass account is optional. By choosing to connect, you authorize:
- The sharing of data between you and the issuing organization,
- The ability for the organization to view certain structured elements of your Talent Tree or achievements (with your consent),
- The use of AI-driven guidance or task assignment relevant to your role.
7.3 Privacy and Consent
We will never share your private reflections, AI conversations, or personal documents with any organization without your explicit consent. Organizations that issue Passport Pages are bound by contractual agreements with Gobekli to uphold platform privacy and ethics standards.
7.4 Disconnecting a Passport Page
You may revoke a Passport Page connection at any time. Upon disconnection:
- The organization will retain a static record of the information already shared,
- Future updates to your Talent Tree or Pythia history will no longer be visible to the organization,
- You may lose access to organization-issued features (e.g., coaching, credentials, or team tools).
5. License and Platform Restrictions
5.1 License to Use TalentPass
Subject to your compliance with these Terms, Gobekli grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal or organizational purposes as intended.
You may not:
- Modify, decompile, reverse engineer, or disassemble any part of the Platform;

7. Passport Pages and Organizational Connections
7.1 What Are Passport Pages?
If you participate in an educational program, employer group, nonprofit, or public agency using TalentSync, you may be issued a Passport Page—a profile stub that represents your role, goals, and participation within an organization.
7.2 Voluntary Connection to TalentPass
Connecting your Passport Page to your TalentPass account is optional. By choosing to connect, you authorize:

11. Governing Law and Dispute Resolution
11.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. If you access the Platform from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
11.2 Binding Arbitration Agreement
You and Gobekli agree to resolve any disputes arising out of or relating to these Terms or the Platform through final and binding arbitration, rather than in court, except for certain claims (see below).
Exceptions:
You or Gobekli may seek injunctive relief in a court of competent jurisdiction for violations of intellectual property rights or misuse of confidential information.
Arbitration Rules:
- The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
- The arbitration will take place in San Francisco, California, unless both parties agree otherwise.
- The arbitrator’s decision will be final and binding and may be entered as a judgment in any court with jurisdiction.
11.3 Class Action Waiver
You agree to bring disputes only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. Class arbitrations, class actions, and private attorney general actions are not permitted.
12. Modifications to These Terms
12.1 We May Update These Terms
We reserve the right to update or modify these Terms at any time. When changes are made, we will update the “Last Updated” date at the top of this document and may notify you via the Platform or email.
12.2 Material Changes
If we make material changes that affect your rights or obligations, we will provide advance notice and an opportunity to review them. Your continued use of the Platform after such notice constitutes your agreement to the updated Terms.
12.3 You Must Stay Informed
We encourage you to review these Terms regularly. If you disagree with any modifications, your sole remedy is to stop using the Platform.
13. Miscellaneous
13.1 Entire Agreement
These Terms, along with the Privacy Policy and any applicable Beta Participation Agreement, constitute the entire agreement between you and Gobekli regarding your use of the Platform.
13.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
13.3 No Waiver
No waiver of any provision shall be deemed a further or continuing waiver of that or any other provision. Gobekli’s failure to enforce any right shall not constitute a waiver of such right.
13.4 Assignment
You may not assign or transfer your rights under these Terms without prior written consent. Gobekli may freely assign these Terms to a subsidiary, affiliate, or acquirer in a merger or sale of assets.
13.5 Force Majeure
Gobekli shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, labor disputes, power outages, or internet service failures.
